Service Agreement

These Terms and Conditions constitute a legal agreement between you ("Client") and The Modern House Co ("Company") governing the use of our home renovation, remodeling, and related services. By signing any contract or work order, you acknowledge that you have read, understood, and agreed to these terms.

Project Scope & Estimates

All project estimates are provided in good faith based on initial consultations. Final pricing may vary if project scope changes, hidden damage is discovered, or client-requested modifications occur. Any changes must be documented in writing through a formal change order signed by both parties.

Payment Terms

• 30% deposit required before materials are ordered
• 40% progress payment at project midpoint
• 30% final payment upon project completion
• Late payments may incur 1.5% monthly interest charges
• All projects must be paid in full before warranty activation

Cancellation Policy

Clients may cancel within 3 business days of signing the contract for a full refund minus administrative fees. Cancellations after work has commenced will be billed for completed work and materials purchased. Deposits for custom-ordered materials are non-refundable.

Warranty Coverage

We provide warranties on workmanship ranging from 2 to 10 years depending on your selected package. Warranty covers defects in workmanship under normal use conditions. It does not cover damage from natural disasters, misuse, modifications by third parties, or normal wear and tear.

Client Responsibilities

Clients must provide safe site access, clear work areas of personal belongings, secure pets, and notify neighbors of construction. Clients are responsible for obtaining HOA approvals unless otherwise agreed. Delays caused by client-side issues may extend project timelines.

Limitation of Liability

The Modern House Co's total liability for any claim shall not exceed the total contract value. We are not liable for indirect, incidental, or consequential damages. Force majeure events including weather, supply chain disruptions, or government mandates may delay projects without penalty.

Governing Law

These terms are governed by the laws of the State of Texas, USA. Any disputes shall be resolved through binding arbitration in Tarrant County, Texas. This agreement represents the entire understanding between parties and supersedes prior communications.
